2018 In Immigration So Far…

We are just a little over a month and a half into the New Year. It has even now proven to be an interesting one in Immigration Law. There have already been many new developments and there are likely to be many more. It is more important than ever to be informed and take advantage of any existing options before they change or are no longer available.

Existing Changes

One significant change in immigration law that has occurred in 2018 is the termination of TPS for El Salvador. Also, following a Federal Judge’s Order, USCIS also began accepting renewals of DACA applications while litigation remains pending. A proposed rule that will remove the ability of spouses of H-1B Visa holders to apply for a work authorization is likely to take affect soon. Some positive changes have also occurred; such as USCIS announcing it will begin accepting credit cards to pay the filing fee for certain applications.

Proposed Changes

Besides the existing changes, there are many proposed changes to keep an eye on. There has been a proposed change to immigration policy that would eliminate many existing categories for family-based petitions. Just this past week a proposed immigration policy failed to pass in the Senate. However, negotiations on immigration reform are likely to continue in Congress. The fate of DACA also hangs in the balance as litigation remains pending and a proposed DREAM Act is yet to be passed.
It is only the beginning of the year and it is highly likely there will be much more movement in immigration policy. What exactly the future holds when it comes to immigration is unknown. This is why it is vital to know your options. Those holding TPS or DACA who have been affected by recent changes may have other options available to them. Even those that may be able to petition for a family member might want to consider doing so sooner rather than later. A consultation with an experienced immigration attorney can assist in being aware of your rights and options available to you.
